These FTTH Virtual Conference Attendance Terms and Conditions (the "Attendance Terms and Conditions") apply between FTTH Council Europe (“FTTH”) and each person, company or other entity (“you” or “your”) accessing the FTTH Virtual Conference on 15 and 16 September 2021 (the "Virtual Conference"). Please read them carefully as they contain important information. By accessing the Virtual Conference, you agree to be bound by these Attendance Terms and Conditions.

Virtual Conference program

The Virtual Conference program will be available on the FTTH Virtual Conference website. FTTH reserves the right to modify the program, format, speakers, content or any other aspect of the Virtual Conference at any time and for any reason, whether or not due to a Force Majeure Event, in each case without liability. No refunds can be granted in case of such modification, for instance in case of cancellation without notification of speakers or any of the Virtual Conference sessions due to unforeseen circumstances.

Virtual Environment Platform

You may use all platforms, websites and applications on which on which the Virtual Conference is hosted (together hereafter the "Virtual Environment Platform") solely for access to the Virtual Conference.

You may not: (i) download, store, reproduce, transmit, display, copy, distribute, exploit or use the Virtual Environment Platform and/or any content thereon for your own commercial gain, (ii) use the Virtual Environment Platform and/or any content thereon in any manner other than in compliance with law and these Attendance Terms and Conditions, (iii) modify, translate, or otherwise create derivative works of the Virtual Environment Platform and/or of any content thereon, (iii) disassemble, decompile, reverse engineer, or otherwise attempt to derive the source code of the Virtual Environment Platform, except and only to the extent that such activities are expressly permitted by applicable law not withstanding this limitation, (iv) infringe the intellectual property rights of FTTH or those of any third party in relation to your use of the Virtual Environment Platform and/or any content thereon, (v) transmit, or procure the sending of, any unsolicited or unauthorised advertising or promotional material or any other form of similar solicitation on the Virtual Environment Platform, and/or (vi) knowingly transmit, send or upload any data that contains viruses, infections, Trojan horses, worms and/or any other code that has contaminating or destructive properties viruses on the Virtual Environment Platform.

You must not attempt to interfere with the proper working of the Virtual Environment Platform (for example, by attempting to circumvent security or tamper with, hack into or otherwise disrupt any computer system, server, website, router or any other internet connected device).

You are solely responsible for your electronic devices, communication devices and other such devices and matters such as hardware condition, internet connection, antivirus, backup, and all other technical requirements needed to enable you to access the Virtual Environment Platform made available by FTTH to facilitate participation in the Virtual Conference.

FTTH does not guarantee that the Virtual Environment Platform will operate continuously, securely or without errors or interruption, and does not accept any liability for its temporary unavailability. FTTH does not guarantee that the Virtual Environment Platform and/or any content thereon (including, without limitation, any content available for download) will be free from viruses, infections, Trojan horses, worms and/or any other code that has contaminating or destructive properties.

Access to the Virtual Environment Platform is subject to the terms of use of our service provider 6Connex https://www.6connex.com/legal/. Please read them carefully as they contain important information. By accessing the Virtual Environment Platform, you agree to and warrant that you will comply with each of these service providers' terms of use and any other terms and/or policies indicated on the service provider websites.

Content

FTTH does not endorse or accept any responsibility for the content, or the use of, any goods or services that may be identified or described on the Virtual Environment Platform and shall not be liable for any loss or damage caused or alleged to be caused by or in connection with use of, or reliance on, any content, goods or services available on or through the Virtual Environment Platform or any website or other resource referenced therein.

FTTH may issue you with a username and password. Usernames and passwords are confidential and remain the property of FTTH at all times and may not be sold, assigned or transferred to any third party without our permission. Your username and password are personal to you. You hereby agree that you will not permit others to use your username or password and you will be and remain liable for the acts of any person using your username and password.

Any posts, messages or other materials, information or data you supply or upload to the Virtual Environment Platform (collectively, “Materials”) will be considered non-confidential and non-proprietary, and FTTH has the right to use, copy, distribute and disclose to third parties any such Materials for any purpose. You hereby waive any moral rights in any Materials to the extent permitted by applicable law. FTTH reserves the right, at our sole discretion, to edit or remove postings to any message boards on the Virtual Environment Platform and delete or use electronic methods to block or filter any Materials at our discretion, but we do not have any obligation to do so. You shall not make libellous postings or any postings which are illegal or infringe the intellectual property rights of any third party. FTTH will not be responsible for monitoring Materials for compliance with law.

Intellectual property

All intellectual property rights in and to the Virtual Conference, the Virtual Conference content, the Virtual Environment Platform and all materials distributed at or in connection with the Virtual Conference are owned by FTTH, the Virtual Conference sponsors or the Virtual Conference service providers. You may not use or reproduce or allow anyone to use or reproduce any trademarks, trade names, logos or other intellectual property rights appearing on the Virtual Environment Platform, in any Virtual Conference content or in any materials distributed at or in connection with the Virtual Conference for any reason without the prior written permission of FTTH.

Title to and ownership of the Virtual Environment Platform shall at all times remain the exclusive property of the relevant third party service provider.

Cancellation, postponement or other unavailability of the Virtual Conference

Should the Virtual Conference be cancelled, postponed or unavailable for an extended period, due, directly or indirectly, to acts or forces beyond the control of FTTH, including, without limitation, strikes, work stoppages, accidents, acts of war or terrorism, civil or military disturbances, epidemics, governmental measures, nuclear or natural catastrophes or acts of God, and interruptions, loss or malfunctions of utilities, communications or computer (software and hardware) services ("Force Majeure Event") or due to events which are not attributable to the wrongful intent or gross negligence of FTTH, including but not limited to extended non-availability or extended non-functioning of (parts of) the Virtual Environment Platform, FTTH shall not be liable towards you for any, direct or indirect, damages, costs or losses incurred, such as ticket purchase price, transportation costs, accommodation costs, costs for additional orders, financial losses, etc. In such event, FTTH reserves the right to either (i) retain the entire ticket purchase price for each ticket and credit it to the registrant having completed your registration for a future event, or (ii) to reimburse the purchase price to the registrant having completed your registration after deducting costs already incurred for the organization of the Virtual Conference and which could not be recovered from third parties.

FTTH shall notify of the cancellation or postponement of the Virtual Conference as soon as reasonably possible.

Limitations of liability

The maximum aggregate liability of FTTH for any claim in any way connected with, or arising from, the Virtual Conference or these Attendance Terms and Conditions, whether in contract, tort or otherwise (including any negligent act or omission), shall be limited to the registration fee amount corresponding to the delegate pass purchased by you or on your behalf.

FTTH shall not be liable to you for any indirect, incidental or consequential damages, including, but not limited to, damages for loss of revenue, profits, business opportunities, data or information, arising under or in connection with these Registration Terms and Conditions, however caused and under any legal theory of liability, including, but not limited to, strict liability, contract, or tort and even if FTTH has been advised of the possibility of such damage.

FTTH shall not be liable to you in respect of any damages, losses or expenses arising out of events not attributable to the wrongful intent or gross negligence of FTTH, including but not limited to (temporary or extended) non-availability and/or (temporary or extended) non-functioning of (parts of) the Virtual Environment Platform.

The limitations of liability in this section will not limit or exclude liability of FTTH for (i) fraud or wilful misconduct, (b) death or personal, or (c) any other matters in which liability cannot be excluded or limited under applicable law.

Personal data protection and cookies

FTTH will process the personal data provided during the registration process and during the Virtual Conference to organize, host and manage the Virtual Conference, and for analysing visitor traffic with a view to improving the Virtual Conference experience for current and future attendants. When accessing the Virtual Environment Platform, your personal data will be processed by our Virtual Environment Platform service providers 6Connex. Please consult their privacy policies available on the 6Connex website (https://www.6connex.com/privacy-policy/) to learn more on how they process personal data.

You agree and warrant that you will not display, post, upload, store, exchange or transmit any sensitive information on or through the Virtual Environment Platform. This information includes, but is not limited to, date of birth, Social Security number, driver's license number, other government-issued identification number, financial account number, credit or debit card number, insurance ID or account number, health or medical information, consumer reports, background checks, biometric data, digital signatures, any code or password that could be used to gain access to financial resources, any other unique identifier, as well as the special categories of personal data as listed in Article 9(1) of the GDPR (together "Sensitive Personal Information").

By accessing the Virtual Conference you acknowledge and agree to grant FTTH the right to record, film, live stream, photograph, or capture your likeness in any media now available or hereafter developed and to distribute, broadcast, use, or otherwise globally to disseminate, in perpetuity, such media without any further approval from you or any payment to you. This grant to FTTH includes, but is not limited to, the right to edit such media, the right to use the media alone or together with other information, and the right to allow others to use or disseminate the media.

When accessing a virtual exhibition booth, downloading sponsor content, or attending a sponsor session, your personal data will be shared with that sponsor to allow them to engage with you. If you accept a connection or meeting invite, your personal data will be shared directly with the delegate(s) or sponsor(s) having sent the connection or meeting invite and they may follow-up and use your details for marketing purposes. Please read the relevant privacy policies of such third parties to understand how they will process your personal data. FTTH does not take any responsibility for marketing messages sent by third parties and the processing of your personal data by such third parties.

Communication and direct marketing

You will receive essential information in relation to the Virtual Conference electronically at the email address that is provided for your registration. Please ensure that such email address is valid and entered correctly in the registration process. Be sure to check your junk email box too in case any of your Virtual Conference emails are caught by spam filters.

You will also be added to the FTTH conference participant list for receiving notifications relating to future virtual or physical conferences by FTTH, including related offers and promotions. You may opt out of marketing communications and object to any processing activities at any time and will be given the option to do so in each communication. FTTH does not take any responsibility for marketing messages sent by third parties.

Conduct

You may not and agree not to disrupt the Virtual Conference, any sponsor's virtual exhibit, any keynote speech or any other part of the Virtual Conference in any way whatsoever

All unauthorized recording or transmitting of audio or visual material of the Virtual Conference, data or information, including but not limited to personal data relating to delegates, is expressly prohibited.

FTTH reserves the right to deny participation to anyone who engages in or is reputed to engage in unethical or non-compliant business practices.

FTTH may, in its sole discretion, refuse you access to or eject and/or block you from the Virtual Conference, should you fail to comply with these Attendance Terms and Conditions or should you, in the opinion of FTTH, represent a security risk, nuisance or annoyance to the running of the Virtual Conference or the enjoyment of the Virtual Conference by other delegates. You agree to comply with all reasonable instructions issued by FTTH or any other operator of the Virtual Conference.

Disclaimer and Waiver

The content on the Virtual Environment Platform is made available "as is". The views, opinions, and positions expressed by the speakers, delegates or sponsors at the Virtual Conference are theirs alone and do not necessarily reflect the views, opinions, or positions of FTTH or any employee thereof. FTTH does not warrant and assumes no responsibility for the accuracy, appropriateness and/or completeness of any information available during the Virtual Conference and/or thereafter on the Virtual Environment Platform. FTTH shall not be liable for any content made available on the Virtual Environment Platform, including by sponsors, speakers and delegates, which infringes, misappropriates or violates intellectual property rights or rights of publicity or privacy of a third party or violates any law, statute, or ordinance. FTTH may make changes to such content, at any time without notice.

FTTH does not endorse, and expressly disclaims all liability relating to, any of the products or services provided or presented by speakers, delegates or sponsors during the Virtual Conference.

You confirm, acknowledge and agree as follows:

The FTTH Conference, organised by the FTTH, is the biggest FTTH related conference in the world. It is recognized as the main networking location for everyone interested in the topic of fibre access networks.

The Virtual Conference is an event for professionals. You warrant that you are not a consumer.

Any investment or purchase decisions made by the delegates are theirs alone and such decision would in no way be influenced by any prior relationship or dealing with the organiser or any of its officers, directors, employees or representatives. The information presented at the FTTH Conference is intended for a general audience and does not purport to be, nor should it be construed as, specific advice tailored to any individual. You agree to hold FTTH, the Virtual Conference sponsors and any speakers completely free from any liability resulting from your attempts to use the strategies that are presented.

You will be liable for any loss or damage you cause when accessing the Virtual Environment Platform.

Links to third party websites

The Virtual Environment Platform may contain links to third party websites, applications and services not operated by FTTH. These links are provided as a service and do not imply any endorsement by FTTH of the activities or content of these sites, applications or services nor any association with their operators. Your browsing on and interaction with any other website is subject to the terms of use and privacy and other policies of such third party website. Read the terms of use and all policies of other websites carefully. FTTH is not responsible or liable for the information or content on such third party websites.

Miscellaneous

All references to a date or a deadline, mentioned in these terms and on other conference documents, refer to the Central European Time Zone (CET), if not marked otherwise.

If any provision in the Terms and Conditions, whether in full or in part, is held to be invalid or unenforceable, all other remaining provisions (in full or in part) shall continue to be valid and enforceable.

The Terms and Conditions shall be subject to Belgian law and the non-exclusive jurisdiction of the Belgian Courts.
