These FTTH Virtual Conference Registration Terms and Conditions (the "Registration Terms and Conditions") apply between FTTH Council Europe (“FTTH”) and the person, firm, company or other entity completing the registration process (“you” or “your”) for the FTTH Virtual Conference on 2 and 3 December 2020 (the "Virtual Conference"). Please read them carefully as they contain important information. By completing a registration for the Virtual Conference, you agree to be bound by these Registration Terms and Conditions.
The standard rate for registrations is EUR 95 excluding VAT per person. All delegate passes purchased before November 1st, 2020 shall include the early bird benefits listed on the FTTH Virtual Conference registration webpage.
The registration fee may be subject to sales tax, value added tax, or other taxes and duties which, if applicable, will be charged to you in addition to the registration fee.
You are required to register all envisaged participants of the Virtual Conference (each a "Delegate") on behalf of which you complete a registration.
By completing a registration, a purchase agreement is concluded between yourself and our registration system provider, GuestOne GmbH, which sells delegate passes allowing access to the FTTH Virtual Conference in its own name and for the account of FTTH. You agree to comply with the GuestOne terms and conditions made available during the registration process.
Each delegate pass purchased from GuestOne GmbH grants one Delegate the right to two-day access to the Virtual Conference, under the terms and conditions made available on the FTTH Virtual Conference registration webpage https://www.registration.ftthconference.eu/.
The Virtual Conference program will be available on the FTTH Virtual Conference website. FTTH reserves the right to modify the program, format, speakers, content or any other aspect of the Virtual Conference at any time and for any reason, whether or not due to a Force Majeure Event, in each case without liability. No refunds can be granted in case of such modification, for instance in case of cancellation without notification of speakers or any of the Virtual Conference sessions due to unforeseen circumstances.
Access to the Virtual Conference is subject to the FTTH Virtual Conference Attendance Terms and Conditions https://www.ftthconference.eu/practical-info/attendance-terms-and-conditions (the "Attendance Terms and Conditions"). Please read them carefully as they contain important information. By accessing the Virtual Conference, you agree to be bound by these Attendance Terms and Conditions.
To the extent that you made a registration for any other individuals than yourself, you warrant that you shall communicate the Attendance Terms and Conditions to all such individuals and procure that all such individuals will have read and accepted the FTTH Attendance Terms and Conditions before accessing the FTTH Virtual Conference.
Should the Virtual Conference be cancelled or postponed due, directly or indirectly, to acts or forces beyond the control of FTTH, including, without limitation, strikes, work stoppages, accidents, acts of war or terrorism, civil or military disturbances, epidemics, governmental measures, nuclear or natural catastrophes or acts of God, and interruptions, loss or malfunctions of utilities, communications or computer (software and hardware) services ("Force Majeure Event") or due to events which are not attributable to the wrongful intent or gross negligence of FTTH, including but not limited to (temporary or extended) non-availability or (temporary or extended) non-functioning of (parts of) one or more of the platforms, websites and applications on which on which the Virtual Conference is hosted (together hereafter the "Virtual Environment Platform"), FTTH shall not be liable towards you or any Delegate for any, direct or indirect, damages, costs or losses incurred, such as ticket purchase price, transportation costs, accommodation costs, costs for additional orders, financial losses, etc. In such event, FTTH reserves the right to either (i) retain the entire ticket purchase price for each ticket and have GuestOne credit it to you for a future event, or (ii) to have GuestOne reimburse the purchase price to you after deducting costs already incurred for the organization of the Virtual Conference and which could not be recovered from third parties.
In the event of a full cancellation of the Virtual Conference due to FTTH's wrongful intent or gross negligence, you will be able to request reimbursement from GuestOne in accordance with GuestOne's terms and conditions.
FTTH shall notify you and, where possible, any other Delegates for which you have completed the registration, of the cancellation or postponement of the Virtual Conference as soon as reasonably possible. Where FTTH lacks the information required to notify other Delegates for which you have completed the registration, you agree to notify those Delegates immediately of the cancellation or postponement following receipt of notification by FTTH.
Should a registered Delegate be unable to attend the FTTH Conference, a substitute Delegate may be nominated by 20 November 2020 without penalty. Requests for change of Delegate can be made by e-mail to: firstname.lastname@example.org.
Cancellations are subject to the entire registration fee. Unless expressly provided in these Registration Terms and Conditions, all sales are final and no payments will be refunded or refundable. Please note that a registered Delegate does not request a change of Delegate and does not access the Virtual Conference, you are still responsible for payment. In no event shall FTTH be obligated to refund all or a portion of the registration fee.
The maximum aggregate liability of FTTH for any claim in any way connected with, or arising from, the Virtual Conference or these Registration Terms and Conditions, whether in contract, tort or otherwise (including any negligent act or omission), shall be limited to the registration fee amount actually paid by you to GuestOne GmbH.
FTTH shall not be liable to you for any indirect, incidental or consequential damages, including, but not limited to, damages for loss of revenue, profits, business opportunities, data or information, arising under or in connection with these Registration Terms and Conditions, however caused and under any legal theory of liability, including, but not limited to, strict liability, contract, or tort and even if FTTH has been advised of the possibility of such damage.
FTTH shall not be liable to you in respect of any damages, losses or expenses arising out of events not attributable to the wrongful intent or gross negligence of FTTH, including but not limited to (temporary or extended) non-availability and/or (temporary or extended) non-functioning of (parts of) the Virtual Environment Platform.
The limitations of liability in this section will not limit or exclude liability of FTTH for (i) fraud or willful misconduct, (b) death or personal, or (c) any other matters in which liability cannot be excluded or limited under applicable law.
You will receive essential information in relation to the Virtual Conference electronically at the email address that is provided for your registration. Please ensure that such email address is valid and entered correctly in the registration process. Be sure to check your junk email box too in case any of your Virtual Conference email(s) are caught by spam filters.
FTTH does not take any responsibility for emails sent by third parties.
The Virtual Conference is an event for professionals. You warrant that you are not a consumer and that you have not completed the registration on behalf of any consumer(s).
You must ensure that all Delegates registered by you act in an orderly manner when attending the FTTH Conference, and in any event act in compliance with the Attendance Terms and Conditions. FTTH reserves the right to refuse access or eject and/or block from the Virtual Conference any such Delegates that are behaving in a disorderly, offensive or inappropriate manner or that do not comply with the Attendance Terms and Conditions.
The information presented at the Virtual Conference is intended for a general audience and does not purport to be, nor should it be construed as, specific advice tailored to any individual.
FTTH assumes no responsibility for the accuracy or appropriateness of any information provided at the Virtual Conference by any sponsor, speaker or any other Delegate.
The Virtual Conference is provided on an "as is" basis. FTTH makes no warranties whatsoever in relation to the use, availability and of the Virtual Environment Platform, and disclaims any express or implied warranties that (i) the Virtual Environment Platform will be secure, timely, uninterrupted or error-free; (ii) errors or defects in the Virtual Environment Platform will be corrected; or (iii) the Virtual Environment Platform will be free of viruses or other harmful code.
All references to a date or a deadline, mentioned in these terms and on other conference documents, refer to the Central European Time Zone (CET), if not marked otherwise.
If any provision in the Terms and Conditions, whether in full or in part, is held to be invalid or unenforceable, all other remaining provisions (in full or in part) shall continue to be valid and enforceable.
The Terms and Conditions shall be subject to Belgian law and the non-exclusive jurisdiction of the Belgian Courts.
